PHMSA updates emergency response information requirements in HM-206F for shipping papers


In an effort to enhance safety — the DOT / PHMSA has issued a final rule relating to emergency response telephone numbers in 49 CFR Parts 172 and 174 via the Federal Register (HM-206F) regarding the requirements of emergency response information provided by offerors (shippers).

To promote the effectiveness and safety of transporting hazardous materials, PHMSA is requiring a contact name or contract number be placed on shipping papers in relationship to the emergency response information. This information must be provided in a prominent position on the shipping paper with acceptable locations being along with the offeror's shipping address, or above/below/in relation to the emergency response information.

Additional wording has been revised in §172.604(b) with new information in §172.604(b)(1) and (2) regarding this matter.

The effective date of this final rule on shipping papers has been amended to October 1, 2010. A voluntary compliance date of November 18, 2009 is also effective on shipping papers.

The DOT / PHMSA will be issuing a new updated final rule regarding this matter later today pertaining to the effective date and new information provided in §172.604(b)(1) and (2), to help clarify its intent.

PHMSA Releases 2008 Enforcement Notice for Hazmat Fines and Penalties; Don't Be Caught With Undeclared Hazmat or Without Hazmat Training!

Receiving fines and penalties for improperly declaring hazardous materials (or failure to declare hazmat at all) can unnecessarily drive up the cost of doing business. It can even put you out of business!

The Pipeline and Hazardous Materials Safety Administration (PHMSA), a division of the U.S. DOT, has published its Enforcement Notice for 2008 regarding fines and penalties incurred on businesses for failing to comply with hazmat regulations.

During the 2008 calendar year, PHMSA has closed 130 cases of Hazardous Materials Regulations (HMR) violations and served $1,135,256.81 in fines for hazmat compliance failure.

The transportation of hazardous materials (hazmat) plays an integral role in our national and world economies, providing key products and resources that we use every day. We consume oil and natural gas to heat our homes and businesses, and produce raw materials for plastics, fibers, paints and other essential products. We use chemicals to clean our water, fuel cars, construct buildings, fertilize crops, create medicines, manufacture clothing and create many other essential commodities.

All of these products and services rely on the safe transportation of hazmat to be shipped around the country. To promote the safe transportation of hazmat, the United States Department of Transportation (DOT) and Pipeline and Hazardous Materials Safety Administration (PHMSA) have established training requirements in the Hazardous Materials Regulations (HMR) to address some of the inherent risks to the public, environment and property that need to be managed.

IMDG training for dangerous goods in Shanghai, China for August 2009

The Tianjin, China office for the Bureau of Dangerous Goods, Ltd. is offering a 3-day IMDG training course from August 5 to August 7, 2009 in Shanghai, China to help promote and improve safety awareness for transporting dangerous goods.

This course is specifically designed to familiarize shippers, freight forwarders and carriers with the safe operation, handling and transportation of dangerous goods by vessel; including regulations, documentation and packaging to meet the requirements of increasingly restricted regulatory requirements from North America and Europe.

Hazmat Safety Awareness Tip: The Overlooked Marking Requirement for Shipping Hazmat

Are you missing something important?

Packaging is the foremost element of all shippers' responsibilities in the safe transportation of hazmat and dangerous goods. This is particularly true when it comes to shipping hazmat by air. Packages that travel by air are subjected to a variety of conditions that are usually more severe than other modes of transport. Some of these conditions include drastic temperature changes, intense vibration and extreme drops in atmospheric pressure. Reductions in pressure tend to cause leakage of liquids or even bursting of the packagings during flight!

So what does this have to do with marking requirements? Well, remembering that the intent of safe hazmat shipping is to ensure that a hazardous material is not released during transport, a shipper must not use packaging for air shipments unless that packaging meets the applicable testing requirements and is closed in a way that ensures resistance to pressure changes throughout the transportation cycle.

Most shippers of hazmat purchase UN standard packagings (e.g. packagings which conform to both the UN Model Regulations and the HMR) for this purpose. These performance-oriented packagings require the application of UN Specification Markings. Normally applied by the packaging manufacturer, these marks are still ultimately the responsibility of the shipper.

Trained hazardous materials shippers are aware of the significance of the UN specification mark, but often overlook the following component:

If your business uses single packagings (e.g. drums, jerricans, etc.) to ship liquid hazmat or dangerous goods by air, a single packaging must have a marked test pressure of not less than...
  • 250 kPa for liquids in Packing Group I,
  • 80 kPa for liquids in Packing Group III of Class 3 or Division 6.1, and
  • 100 kPa for other liquids, or
  • a pressure related to the vapor pressure of the liquid to be conveyed, whichever is greater (see reference 49 CFR 173.27(c) and IATA DGR 5.0.2.14 and DGR 6.3.5).

Standardizing hazmat cargo information for first responders to arrive at an emergency scene involving an aircraft

For all first responders to arrive at an emergency scene involving an aircraft, one of the primary considerations is: Is there any hazmat (hazardous materials, dangerous goods) on board, and if so, where and how much?

The Bureau of Dangerous Goods, Ltd. has the answer. Airlines have begun using a commercially available software and Internet application known as HAZMAT®. Built into this software is a module called the NOTOC Navigator. This module is capable of generating automated, fully compliant NOTOC (Notification to the Pilot in Command) documentation containing all applicable emergency response information related to the cargo at the emergency scene. Emergency response information contained on the NOTOC is based on the North American Emergency Response Guidebook (ERG) and the United Nations International Civil Aviation Organization (ICAO) Emergency Response Guidance for Aircraft Incidents Involving Dangerous Goods (Red Book).

In addition, the name of the chemical, it's UN identification number, class hazard, the degree of danger (UN packing group number), quantity per package, a description of the package and where on board the aircraft the package is located are also provided on the NOTOC for each hazmat package.

Emergency response information from the NOTOC Navigator is available from the participating airline involved to any first responder via electronic transmission. Each NOTOC can be electronically mailed to any MAPI-compliant email address anywhere around the world within seconds.

The Bureau of Dangerous Goods, Ltd. is dedicated to promoting the idea of standardizing the information on NOTOCs. This process would help eliminate the potential for individual interpretation and give first responders immediate access to information pertaining to hazmat on board a downed aircraft, how to minimize and contain contamination, and improve safety protocol in handling hazmat at an emergency scene. The NOTOC Navigator accomplishes each of these tasks by producing a standardized document with the necessary information that first responders need to secure and contain an emergency scene involving an aircraft and hazmat.

Proper classification of dangerous goods transported by aircraft is the first step towards compliance

The proper classification of dangerous goods to be transported by aircraft is the first step towards achieving regulatory compliance and promoting a safe work environment for everyone involved. Classifying dangerous goods creates a standard method of universal communication regarding the type of dangerous good or hazardous material being transported. This is especially important because most dangerous goods are transported in opague or non-transparent containers and packagings, making it near impossible to identify the contents inside. By properly classifying a dangerous goods shipment along with the correct labels and markings, we can help reduce the risk of accidents including spills, explosions, corrosion, radiation and more.

The IATA Dangerous Goods Regulations, along with the ICAO Technical Instructions for the Safe Transport of Dangerous Goods by Air, classifies dangerous goods into nine distinct class hazards. Some of these class hazards are further divided into divisions, each with specific criteria to classify the division from others.

These are the nine class hazards and their respective divisions:

  • Class 1: Explosives
    • Division 1.1: Articles and substances having a mass explosion hazard
    • Division 1.2: Articles and substances having a projection hazard but not a mass explosion hazard
    • Division 1.3: Articles and substances having a fire hazard, a minor blast hazard and/or a minor projection hazard but not a mass explosion hazard
    • Division 1.4: Articles and substances presenting no significant hazard
    • Division 1.5: Very insensitive substances having a mass explosion hazard
    • Division 1.6: Extremely insensitive articles
  • Class 2: Gases
    • Division 2.1: Flammable Gas
    • Division 2.2: Non-flammable, non-toxic gas
    • Toxic gas
  • Class 3: Flammable Liquids
  • Class 4: Flammable Solids; Substances Liable to Spontaneous Combustion; Substances Which, in Contact with Water, Emit Flammable Gases
    • Division 4.1: Flammable solids, self-reactive substances and solid desnsitized explosives
    • Division 4.2: Substances liable to spontaneous combustion
    • Division 4.3: Substances which, in contact with water, emit flammable gases
  • Class 5: Oxidizing Substances and Organic Peroxides
    • Division 5.1: Oxidizers
    • Division 5.2: Organic peroxides
  • Class 6: Toxic and Infectious Subsssstances
    • Division 6.1: Toxic substances
    • Division 6.2: Infectious substances
  • Class 7: Radioactive Material
  • Class 8: Corrosives
  • Class 9: Miscellaneous Dangerous Goods

There are dangerous goods and hazardous materials that have multiple class hazards assigned. Section 3.10 in the IATA DGR describes the criteria for assigning a dangerous good with multiple hazards. In this case, the most restrictive of packing groups between the hazard classes must be assigned to the dangerous goods.

ShipHazmat.net is an Internet application for creating fully compliant dangerous goods documentation and packaging required to transport dangerous goods by aircraft internationally. Users can simply log in and begin using ShipHazmat.net knowing that their documentation will be fully compliant with all applicable regulations.

ShipHazmat.net is available for purchase online in two different flavors:

Hazmat training is required by law for all employees who work with and transport dangerous goods or hazardous materials

This is a friendly reminder that hazmat training is required by domestic and international law for all employees who work with and/or transport dangerous goods or hazardous materials by air, ground or ocean. The requirements for hazmat training are based on the specific mode of transportation used along with the job function(s) performed by the employee(s).

With regards to U.S. law, the employer/employee must adhere to the training requirements governed under 49 CFR, Subpart H regardless of job function and mode of transportation.

It is the employer's responsibility to make sure that employee(s) receives hazmat training. Employee(s) may not perform their job duties unless such training has been received. The employer can outsource hazmat training from a third party hazmat training provider. Employee(s) has 90 days from date of hire or change in job function to receive training, during which time can perform such duties under the direct supervision of a properly trained and knowledgable hazmat employee.

Employee(s) must be trained in the following areas:
  • General awareness training
  • Function-specific training
  • Safety training
  • Security training

Employers must keep training records for their employee(s) pertaining to their current training record along with the preceding three years. Such records must be kept for an additional 90 days after an employee leaves or is terminated.

Dangerous goods online hazmat training coming soon to a computer near you!

In a weakened economy, sending employees to an outside training course for a day or more becomes more costly than ever. Updated label wizard helps find the proper label(s) and placard(s) for shipping dangerous goods by multi-modal transport

Our Bureau of Dangerous Goods label wizard engine takes user input and performs a "smart" search of any matching UN number or proper shipping name entered. These matching results are returned to the user in real time for on-the-spot selection and viewing.

Once the proper label(s) and/or placard(s) is displayed, users also have the option to purchase from our sister company, DG Supplies. The latest amendments to the 50th edition of the IATA DGR include several new and amended State and Operator variations, updated information regarding mixtures and solutions, and a new Special Provision A165 that affects specific proper shipping names related to division 1.4S.
